Terms & Conditions of Service

  1. Definitions and interpretation

“We”, “us”, “our” means MyFlyPass.

“You”, “your” means the client or traveller who makes a booking or uses our services.

“Booking” means a reservation made by you for a travel product via us.

“Supplier” means the third‑party travel providers (airlines, hotels, tour operators) whose services you book.

“Services” means the travel agency services we provide – booking, advisory, facilitation.

  1. Application of terms
    These Terms & Conditions apply to all bookings made with us (in store, by phone, email or via our website). You must be at least 18 years old (or have parental/guardian consent) to make a booking.
    By making a booking you confirm that you have authority to act on behalf of all travellers on the booking and bind them to these terms.
  2. Our role / agency arrangements
    We act as agent for the Suppliers (unless we explicitly say otherwise). We endeavour to provide accurate information but do not warrant or guarantee any service provided by a Supplier. Your contract for the travel products is directly with the Supplier; we arrange on your behalf.
  3. Bookings / payments

A deposit or full payment may be required at the time of booking.

You must pay the balance by the required due date, otherwise the booking may be cancelled and fees retained.

Prices are as quoted at the time of booking. We reserve the right to pass on changes (for example airline fare increases, currency fluctuations, taxes) until full payment is received.

  1. Cancellations, changes, refunds

If you cancel or change your booking, the Supplier’s (and our) cancellation/change fees apply.

Some bookings may be non‑refundable or subject to strict change conditions—make sure you check.

We are not liable for refund where the Supplier refuses a refund beyond their own terms.

  1. Travel documentation

You must hold valid passports, visas, travel insurance, health certificates and ensure names match the booking. We are not responsible for you being denied travel due to incorrect documentation.

  1. Responsibility and liability

Our liability to you is limited to the extent permitted by law. We are not liable for indirect, consequential or special loss or damage (including lost profits, missed opportunities).

We do not guarantee the performance of the Supplier. If the Supplier fails, you have recourse against them; we will assist but only as a facilitator.

Nothing in these terms excludes your rights under the Consumer Law (e.g., the Australian Consumer Law) where they apply.

  1. Special requirements / health / mobility
    If you or a traveller have a disability, medical or dietary requirement you must advise us at the time of booking. We will pass on the information to the Supplier but do not guarantee the Supplier can meet all special requirements.
  2. Changes by us / Suppliers

We may make changes or cancel services due to circumstances beyond our control (force majeure, supplier default, flight cancellation etc). We will endeavour to inform you; extra costs may be payable.

The Supplier may impose schedule changes, fare increases, route changes etc—these are outside our direct control and may affect your booking.

  1. Governing law and jurisdiction
    These terms are governed by the laws of the State/Territory in which MyFlyPass is registered (e.g., New South Wales or Victoria) and by the laws of the Commonwealth of Australia. You submit to the non‑exclusive jurisdiction of the courts of that State/Territory.
  2. Variation of terms
    We may change these Terms & Conditions at any time by publishing the amended version on our website. The amended version will apply to bookings made after the date of publication.
  3. Privacy and Data
    When you make a booking with us, you consent to our use of your personal information in accordance with our Privacy Policy (as above). If you do not agree, please do not proceed with the booking.
  4. Severability
    If any provision of these terms is held to be invalid or unenforceable, that provision shall be severed and the remainder shall continue in full force and effect.
  5. Definitions of consumer guarantees
    Nothing in these terms is intended to exclude rights you may have under the Australian Consumer Law or other applicable laws. If any right cannot be excluded, we limit our liability to the minimum permitted by law.
